Although filing for bankruptcy can temporarily stop foreclosure, it most often just DELAYS the inevitability of foreclosure. Furthermore, bankruptcy creates a lasting negative mark on your credit, even years after filing, making recovery difficult in the long run.
Many people file for bankruptcy under the hope that everything will work out in the end; however, in most cases, bankruptcy leads to higher legal fees, various costs and ultimately, the loss of homes.
Unfortunately, buying more time doesn’t necessarily mean that problems will work themselves out in the end. I am not an attorney and this is not legal advice, however it’s important to be honest with yourself also realistic about where you will get the money to make the payments necessary to keep your home. In my experience I have never met one homeowner who has said they spoke to a bankruptcy attorney and were told bankruptcy was not a good option. For this reason alone, it’s important for homeowners to be aware of all the options available to them so they can make an informed decision as to what is right for them.
In my opinion, bankruptcy does make sense for certain situation, however, there are other options. In most cases it’s best that those options are explored before filing for bankruptcy. Please remember that most bankruptcy attorney’s will tell you that filing for BK your best option, however, we have found that many times this was actually not the case.
